With the passage of the Affordable Care Act (ACA), Congress mandated that overpayments must be reported and returned within 60 days of being “identified."  This legislative change and the recently issued proposed implementing regulations have imposed substantial new obligations on healthcare providers. Coupled with earlier amendments to the False Claims Act, the ACA has changed the landscape in matters involving possible overpayments, regulatory lapses or violations of the law. The new environment raises serious questions about whether we have reached the end of the “voluntary disclosure” era in healthcare and entered the new era of “mandatory disclosures.”  This dramatic shift toward mandated reporting will result in new challenges for healthcare providers, their counsel and compliance personnel.
