Businesses such as financial institutions and nonprofit organizations rely on Becca Brinkley for advice and counsel in civil litigation at both the trial and appellate levels of state and federal courts.  Ms. Brinkley also represents owners of construction projects in the healthcare industry, who rely on her for advice and counsel in disputes in court and before alternative dispute resolution tribunals, as well as in the preparation of design and construction related agreements.  Ms. Brinkley is an associate with Waller Lansden and practices in the area of trial and appellate litigation. 

In 2011, Ms. Brinkley spoke about bid protests at a construction law seminar presented by the Tennessee Bar Association. In 2010, she served as panelist at a nonprofit seminar sponsored in part by the Center for Nonprofit Management, addressing “Fiduciary Duties, Conflicts of Interest, and Illegal Private Gain in the Nonprofit World.” 

Representative Experience

A financial institution relied on Ms. Brinkley in the successful defense of a claim brought by a former agent before the Financial Industry Regulatory Authority (FINRA) seeking damages and expungement of the institution’s disclosures on a Form U-5.

Following the completion of construction of an assisted living facility, Ms. Brinkley defended the owner of the facility against claims filed by the general contractor seeking over $1 million in payment for alleged change orders.  Ms. Brinkley pursued counterclaims on the owner’s behalf for completion costs and damages related to defects. 

In a government investigation regarding the finances of a nonprofit organization, Ms. Brinkley advised the nonprofit organization and board members in anticipation of and following its receipt of a civil investigative demand.

The State of Tennessee was assisted by Ms. Brinkley in the successful return of the $100 million Maddox Foundation to Tennessee after the organization’s controversial move to Mississippi. The case involved litigation in trial and appellate courts in three states, and garnered extensive coverage in the national media.
