Justin McNaughton is an associate with Waller Lansden and practices in the area of intellectual property law. He has experience negotiating customized software licenses, particularly related to the healthcare industry. Mr. McNaughton has experience investigating and analyzing rights in trademarks, patents, copyrights, trade secrets, and internet domain names for numerous clients as part of the purchase or sale of a business. He provides counsel to clients with respect to open source software issues, software ownership issues, and other professional services.
Mr. McNaughton also assists clients in franchising and trademark licensing matters, including preparation, review and registration of Franchise Disclosure Documents. Mr. McNaughton assists clients in the selection, registration, maintenance and protection of trademarks and service marks in the United States and abroad. He has successfully resolved internet domain name disputes for clients against infringers and typosquatters through arbitration before the World Intellectual Property Organization, as well as trademark opposition proceedings before the United States Trademark Trial and Appeal Board.
Mr. McNaughton has also negotiated numerous pharmaceutical product purchasing agreements across both the generic and branded pharmaceutical industry, as well as pharmaceutical technology transfer agreements.
