John Park is an associate with Waller Lansden. Practicing in the area of labor and employment law, Mr. Park defends employers in a wide range of industries against allegations of discrimination, harassment, retaliation and wrongful discharge arising under all major federal and state employment laws. He has also defended numerous claims brought under the FLSA, ERISA, and the whistleblower provisions of the Sarbanes-Oxley Act. Mr. Park also regularly assists in enforcing, defending, and obtaining injunctive relief in non-compete and trade secret actions on behalf of employers.
Mr. Park has experience in class and collective action litigation, including discovery on statistical experts, opposing class certification, and resolution of multi-plaintiff actions. His trial and appellate experience includes three federal court jury trials, as well as briefing and oral argument before the Sixth, Eighth, Ninth, and Eleventh Circuit Courts of Appeals and the Tennessee Supreme Court and Tennessee Court of Appeals. Mr. Park has been counsel for employers obtaining defense verdicts in separate jury trials in federal courts in Alabama and Texas, including a two-plaintiff whistleblower retaliation case against a healthcare facility. Mr. Park has obtained summary judgment on claims of discrimination, retaliation, and harassment in various courts in Tennessee, Alabama, Texas, and Georgia.
Mr. Park regularly provides advice and counsel to employers in all areas of employment and labor law, including implementing multi-state reductions in force, conducting wage and hour audits, and preventing and addressing issues arising under the NLRA and Collective Bargaining Agreements.
Mr. Park is a frequent speaker and published author on a wide range of labor and employment topics.
