Beginning with conceptual design through final completion and beyond, Waller Lansden assists clients with the critical legal issues involved in the design, construction and development of new commercial, industrial and residential projects in many states, including Tennessee, California and Hawaii. We represent owners, developers, designers, contractors, subcontractors and suppliers with both transactional and dispute resolution needs, with particular experience in the representation of owners.  The firm currently represents clients in major development projects involving mixed-use high-rise construction, hospital and healthcare facilities, high-end retail developments and lifestyle centers, large-scale residential developments, corporate headquarters and office buildings.


Whether our clients need assistance with project delivery selection or construction insurance guidance, our attorneys review, prepare and negotiate design and construction agreements.  We have extensive experience with the major form agreements published by the American Institute of Architects, the Associated General Contractors of America and the Engineers Joint Contract Documents Committee.

Waller Lansden also represents clients in construction-related disputes involving issues of payment, workmanship and construction defects, design issues, liens and surety performance, and completion delays.  We have successfully mediated, arbitrated and litigated a wide variety of construction-related disputes.

Our work for construction clients is often complemented by our experience in government relations and real estate.  Waller Lansden's government affairs and real estate attorneys represent some of the most active real estate developers across the Southeast.  We have represented numerous proponents with regard to the governmental approvals and local incentive aspects of major development projects including the Cool Springs commercial development in Franklin, Tennessee; the Turkey Creek commercial development in Knoxville, Tennessee; and downtown Nashville's new Viridian, ICON, Encore and Signature Towers.  Waller Lansden also represents several of the state's largest trade associations, including the Tennessee Road Builders Association, American Resort Development Association and the Tennessee Chamber of Commerce and Industry among others.

The firm's real estate practice is national in scope and includes both commercial and residential real estate developers as well as corporate clients in a wide range of industries, with a great deal of experience in the area of medical real estate.  Our real estate attorneys have in-depth experience with the design, construction, development, acquisition, lease and disposition of multi-tenant office buildings, hotels and shopping centers, hospitals, medical office buildings and other healthcare facilities, as well as manufacturing facilities, hospitals, telecommunications facilities, apartments and unimproved parcels.
