Administrative and Legislative Advocacy

A critical component of representing clients today in the environmental, health and safety arena is the skill and knowledge of how the legislative and administrative process works and the key players in those roles.  Waller Lansden’s environmental team has years of experience and success in protecting clients’ interests in the legislative arena and the administrative arena at both the federal and state level.  Whether it is working to build draft proposed legislation or rules defeating the same or modifying to protect our clients’ interest, the Waller team can develop a strategic and substantive approach to meet the client’s goals.  Examples of recent efforts include:

Significant Matters
  • Drafting and building coalition to pass silica reform legislation in the State of Tennessee, one of only a few states to adopt such reform to protect business
  • Represent drycleaner industry trade association to pass legislation and develop implementing regulations to provide financial protection for drycleaners facing costly perchloroethylene cleanup
  • Assist ethanol industry representation on development of EPA rule to facilitate construction of substantially larger ethanol facilities without triggering new source review
  • Obtaining regulatory relief for brick and ceramic industry from conflicting federal and state requirements
  • Represent coalition of industry members in obtaining expedited adoption at state level of Clean Air Act NSR reform rules
  • Defeat initiative by state air regulatory program to adopt odor regulations and state air toxics program
  • Negotiate with state regulatory agency on behalf of road construction industry to avoid initiative to regulating existing source off-road vehicle emissions in favor of voluntary retrofit program and financial incentives for same
