Additionally, we advise clients on rights to license as well as protect and exploit copyrights in computer software, audio recordings, musical compositions and arrangements, literary works of fiction and non-fiction, photographs, paintings and other artwork and a wide array of other copyrightable materials.
Franchising
Franchising combines the advantages of a central system with the capital and micro-management of local independent business persons to produce a market competitor with critical mass. The potential geographic expansiveness and long term business relationships cause franchising to be affected by an array of dynamic federal, state and local laws. Waller Lansden attorneys have the depth and breadth of experience to navigate our clients through this intensely regulated area providing a wide variety of services, including corporate, litigation, trademark, registration and licensing, to assure full compliance.
Trademarks
Our attorneys counsel clients regarding selecting and using trademarks, handling registration procedures before state trademark offices and the United States Patent and Trademark Office, and litigating infringement issues related to registered and common law trademarks. We also continually track the trademark to protect it from expiring. Waller Lansden also has counsels clients regarding foreign trademarks for international business.
Trade Secrets
As technology has grown and become more widely accessible, the necessity for trade secret protection has become a vital aspect of intellectual property law. Many intellectual property owners are exploring the benefits and advantages of trade secret protection where patent and/or copyright protection is unavailable or insufficient for their particular needs. Our attorneys advise clients on the propriety of trade secret protection for particular items of intellectual property, provide counsel regarding the appropriate procedures and safeguards for protecting trade secrets and litigate trade secret infringement.
