Labor and Employment

Waller Lansden's team of labor and employment attorneys represents employers throughout the country.  We have successfully defended public and private companies against single plaintiff, multi-plaintiff and class action lawsuits in a wide range of industries, including healthcare, hospitality, retail, manufacturing, insurance, banking and financial services, wireless communications, package delivery and the nonprofit sector.  Whoever the employer and whatever the case, our client's desired result becomes our singular focus.

We strive to be viewed as a valued business partner. Not all matters and not all clients call for the same approach; we analyze and discuss each new matter with the client up front.  By understanding the objective, we can tailor our advice and our service to achieve that objective in the most effective and efficient manner.  We provide practical, usable advice. We do so by learning and keeping up with clients' businesses and industries.  Client service is our fundamental goal, and we extend that service to our clients whenever they need us -- day or night.

Through negotiation or alternative dispute resolution, our employment attorneys frequently resolve workplace matters before they reach the courtroom.  When early resolution and settlement are not our clients' desired goals, however, we have the talent and experience to litigate aggressively the most complex and contentious labor and employment cases.  We represent employers in lawsuits in courts around the country, and in disputes before the Equal Employment Opportunity Commission, the National Labor Relations Board, the United States Department of Labor, Department of Justice and other federal, state and local agencies across the country.

To serve our clients fully, Waller Lansden's Labor and Employment practice extends far beyond the defense of employment litigation.  Our clients rely on our experience for advice and counsel on operational issues, and we regularly update them on the ever-evolving range of issues in employment and labor law.  We help our clients foster a productive workplace and minimize disruptive employment disputes.  We develop customized on-site training programs on topics ranging from wage and hour regulations to sexual harassment and discrimination to dealing with difficult employees.  We also help our clients by drafting employment contracts, policies and manuals, including employee handbooks, leave policies, work rules, arbitration agreements, drug and alcohol testing policies, non-competition agreements and separation agreements.

We have extensive experience in the area of organized labor.  We counsel management on union avoidance techniques and assist companies with legal and strategic issues during election campaigns, representation elections and collective bargaining negotiations.  Our attorneys also represent employers before the National Labor Relations Board, in labor arbitrations under collective bargaining agreements and in other labor-related litigation.
