Toy company wins trade dress and copyright infringement case

A toy manufacturer and distributor became involved in trade dress issues and copyright infringement over a bubble leaf blower toy. The toy distributor did not have any registered marks with respect to the packaging of its toys.

Waller successfully advanced a claim of trade dress infringement and copyright infringement that resulted in the defendant changing the graphics of its packaging of a product that resembled our client’s product.
