Bondholders representative litigates against principals of an ALF in Florida

The bondholders representative litigated against the principals of an Assisted Living Facility in Sarasota, Florida with a $38 million bond indenture.

Waller’s litigation included dissolution of garnishments filed by judgment creditors against the assisted living facility’s operating account(s) and suit against principals for taking personal loans secured by the bondholder’s collateral. Waller also organized appointment of a federal receiver to take control over the going concern assets secured by a defaulted bond indenture.
