Psychiatric services organization battles high stakes psychiatric malpractice case

A patient of a psychiatric services organization allegedly experienced a psychotic break after having his anti-psychotic medication switched, and in the midst of that break, he stabbed his father to death in a gruesome and high-profile murder case. After being found not guilty by reason of insanity, and being involuntarily confined in a facility for the criminally insane, the patient brought a malpractice action in which he blamed the psychiatric services organization for the death of his father and for his involuntary confinement.

Waller successfully defended the organization against a series of aggressive litigation tactics, including a motion alleging intentional destruction of medical records and took extensive written, electronic, and oral discovery in order to position to the case for a reasonable and confidential settlement and help avoid a series of potential regulatory issues raised by the plaintiff in the litigation.
