The songwriters of a No. 1 pop song and their music publishers were sued for alleged copyright infringement. The plaintiff claimed that the intros to the two songs, which were repeated, made the songs "strikingly" similar, and that the defendant songwriters must have had access to her song through the Internet or otherwise.
Waller served as lead counsel to nearly all of the defendants in the case, first obtaining a bifurcation of discovery into liability and damages phases. Following some fact discovery, the case was successfully resolved.
