DSO obtains injunctive relief against dentist for breach of employment agreement

A dental support organization (DSO), offering human resources, marketing, billing, finance, construction management and insurance services to dental practices, filed a complaint and sought a temporary restraining order (TRO) in Tennessee Chancery Court against a dentist and his wife for, among other things, a breach of the dentist’s employment agreement and the intentional interference with business relationships. The court granted the TRO and subsequently granted our client’s request for a preliminary injunction. After granting the preliminary injunction, the court assessed $82,000 in sanctions against the dentist and his wife after Waller uncovered multiple continuing violations of the injunction. The DSO sought actual, treble and punitive damages along with their attorneys’ fees in an amount over $1.6 million.

Waller represented the DSO in the lawsuit, filing the restraining order and advising the DSO in subsequent proceedings.
