Waller defends national franchisor in termination case

Following a franchise termination by a national franchisor of a California-based franchisee, Waller's franchisor client filed an action for trademark infringement and breach of contract. The terminated franchisee filed a separate action, alleging a host of claims including breach of contract, RICO, consumer protection-class action, and national origin discrimination.

Waller serves as lead counsel, and has obtained the dismissal of multiple counts including RICO, class action claims, all California-law claims, and implied covenant of good faith and fair dealing. Waller also obtained the transfer of the franchisee's later-filed lawsuit, combining it with the franchisor's suit. The franchisor's summary judgment is pending.
