Bank defends against $200 million embezzlement claim

Following the discovery of a $200 million embezzlement perpetrated against several casualty insurance companies, the state insurance commissioners of five states brought a civil action against their bank, AmSouth Bancorporation, to recover the loss to the insurance companies.

Defending AmSouth, Waller successfully removed the case from Mississippi state court and had it transitioned to the U.S. District Court for the Middle District of Tennessee. After an interlocutory appeal to the Sixth Circuit Court of Appeals, Waller negotiated a nominal settlement of the claims below the cost of defense.
